These terms and conditions apply to the use of this website at www.uaarty.com (the “Website”). By accessing this website and/or placing an order, you agree to be bound by these terms and conditions.
These Terms and Conditions (Terms), along with our Privacy & Cookies Policy (found within our Help & Info Section), provide information about us and the legal terms and conditions on which we sell goods and services (Products) on the www.uaarty.com website (Website) to you. Any reference in these Terms to we or us refers to UAARTY.
These Terms will apply to the use of this Website and any contract between us for the sale of Products to you (Contract). Please read these Terms carefully and make sure that you understand them, before you use this Website. By accessing this Website and/or placing an order, you agree to be bound by these Terms. Using this Website indicates that you accept these Terms regardless of whether or not you choose to register with us or order from us. If you do not accept these Terms, do not use this Website. These Terms, and any Contract between us, are only in the English language.
We recommend that you print a copy of these Terms or save them to your computer for future reference.
Ordering from us
You are deemed to place an order with us by ordering via our online checkout process. We will send you an order acknowledgement by email, detailing the products that you have ordered.
Please note that we reserve the right to brand our personalised products.
Either following an order acknowledgement sent, or otherwise, we may refuse to accept an order if:
(a) Where goods are not available
(b) Where we are unable to obtain authorisation for your payment
(c) If there has been a pricing or product description error
(d) If you do not meet any eligibility criteria set out in our terms and conditions
(e) If your order for personalised products contains content which we deem as threatening, obscene, indecent, seditious, offensive, pornographic, abusive, defamatory, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience.
Delivery
We will deliver the Products ordered by you to the address which you state for delivery when you place your order. If any of the address details you stated when placing your order are incorrect, we will not be held liable for any items which have not been received.
You will be required to pay for delivery unless otherwise stated. You will be provided with the total price of the transaction including postage and packing before you complete your purchase. There are no hidden extra costs. All our delivery charges are set out on our website.
You may specify a delivery address which is different from your billing address.
Delivery will be made as soon as possible. Our normal working hours are Monday to Friday 10am - 5pm. We only process and dispatch orders during these timescales. All delivery and dispatch timescales quoted on the website do not include weekends or bank holidays.
Whilst we make every effort to deliver goods within the specified timescale, on occasion due to unforeseen circumstances we cannot always guarantee delivery in specified timescale, or accept liability for deliveries made outside this timescale. We cannot accept liability for out of pocket expenses or other costs incurred due to failed or delayed deliveries.
In the event you have not received your order, we must allow the following timescales before we can take further action, and claim back from the relevant carrier for lost items.
Courier delivery: 14 working days from date of dispatch
All Royal Mail deliveries: 28 Days from date of dispatch
We are not liable should delivery not be possible due to the recipient not being home. If your parcel is held at a delivery/couriers depot, it is yours, the customer's responsibility to collect or rearrange delivery direct with them.
Order Cancellations
For most items, you have the legal right to cancel your order within 14 working days of receiving the goods. Unfortunately, this does not apply to items which we have made-to-order, personalised or customised specifically for you, unless of course, the product is deemed to be faulty (see ‘Faulty Items’ below).
If you wish to edit your personalisation, you can do so up until the point of production. Please contact us at the earliest opportunity after you become aware of the need to make changes, so that we can identify if production has already started on the order. Please either call us (on +44 (0) 333 335 5403) or use our website chat function, to ensure that the enquiry is dealt with as promptly as possible, due to the potential delays that email can experience.
Please note: In order to provide the quickest service possible, some products are sent for production almost immediately upon order received. Please check your order on screen and the confirmation email carefully as we cannot refund products which have errors in the text provided to us.
Returns and exchange
For NON-Personalised goods or ‘Ready To Go’/Ready-To-Ship’ Stock Items –
If you are not completely satisfied with your non-personalised goods, please inform us of your wish to return them within 14 days of the date of receipt, and we will issue a RMA number for the return. This can be done by logging into your account on the website, navigating to your previous orders, opening the order detail and if you are within the permitted time frame, an option will be shown to click on to request a return number. The goods must then be returned to arrive with us within a further 14 days of an RMA being issued. Once received, checked & confirmed/approved, we will issue a full refund or an exchange. The term ‘full refund’ is to include both the purchase cost of the goods and any addition shipping that was charged at checkout. The item is your responsibility until it reaches us. For your own protection, we recommend that you send the parcel back to us using a delivery service that insures you for the value of the goods as we cannot be held responsible for items damaged or lost in the post.
For All Personalised Goods or Made-To-Order (all products that are NOT ‘Ready To Go’/Ready-To-Ship’ Stock Items)-
We cannot accept returns of any products that we have made-to-order, personalised or customised specifically for you, unless they are deemed to be faulty.
For ALL goods returns:
We cannot accept returns under the following conditions:
- Where, in our opinion, you have not taken reasonable care of goods whilst in your possession and have not been returned with the original packaging.
- If you have made a spelling mistake on your order and it has been sent for production.
- You have disposed of the item you have an issue with
If you return an item because of an error on our part, or because it is defective, we will refund the full value of the item and postage (shipping receipt may be requested), however returns under all other conditions will not have return shipping re-funded. To re-emphasise, due to the nature of personalised or customised products being manufactured for a specific order, we cannot accept returns if you have a change of mind.
Faulty item(s)
If you discover the item you have received is faulty, or if the item develops a fault within the stated guarantee period, please contact us with the order number, nature of fault, your name, and the purchase date. We will then advise you on how to proceed.
Our standard policy for a fault that occurs within the first 30 days after delivery, we offer a full refund or a replacement item. For faults that occur after the 30 day window, we offer a repair or replacement, dependant on which is more suitable for the nature of the fault and product.
In any event or under any of the above terms and conditions, refunds cannot be given if the fault is as a result of misuse.
Product Image Colour & Accuracy
For ALL wood products - The colour you see on your PC monitor or device screen may not be a true representation of the colour of the wood. Each piece of wood will also have a range of colours in the grain that can vary between each and any other piece. Two items bought in the same wood, even at the same time, may also vary in colour and shade. If you require two or more items from the same range to match in sequence/colour/shade/grain pattern (e.g. cut from the same wood in sequence), please contact us so we can manufacture the items from the same piece of wood and ensure continuity. Please ensure this is understood before purchase, and if colour is important to you, your order is placed at your own risk.
Regional Tide Clock Compatibility
Not all UK coastline tide patterns are compatible with this tide clock, therefore please confirm your desired location is compatible before purchase. For information on how to check, please visit our information pages section for Tidal information
